New developments / legislation
The transposition of the European Directives into German Law was broadly discussed in 2020. The Law was passed on May 20, 2021 by the German Parliament implementing both the DSM Directive and the Online SatCab Directive and will be effective by June 7, 2021.
Most importantly for VG WORT, the entitlement for publishers to a share of the compensation for exceptions and limitations is set as an explicit right in the law.
The new legislation also contains rules on the copyright liability of service providers for sharing online content (Copyright Service Provider Act - UrhDaG-E) - Article 17 of the DSM Directive - and introduces extended collective licencing, i.a. for the licensing of out of commerce works by cultural heritage institutions.
New developments / court cases
The Federal Court of Justice ruled in favour of VG WORT against a national PC manufacturing company in 2020, the case dealt with the legal situation before 2008.
An ongoing case in front of the Munich Regional Court filed by a scientific author in 2019 challenges the participation of editors in the distribution of VG WORT, the claim is directed against cultural aids by the “Förderungsfonds Wissenschaft” of VG WORT as well.

New developments / licensing
For Intranet uses in schools from March 2018 onwards, VG WORT was able to conclude a new agreement with the German Länder. The agreement covers a step by step increasing remuneration covering uses of all types of works in a bundle agreement and will be effective until July 2023.
