New developments / legislation
The new German law on Copyright for Science and Education (UrhWissG) came into force in March 2018. The now broader legal licences makes changes necessary in the VG WORTs contract of representation as well as in the distribution plan and agreements accordingly. In the course of 2018, VG WORT was able to negotiate a number of contracts with education institutions and public bodies to ensure income on the basis of the legal changes.
New developments / court cases
Following the court decision of April 2016 of the highest German court (BGH) Vogel v VG WORT), holding that publishers have neither a neighbouring right, nor a claim to remuneration for exceptions under German copyright law, notwithstanding § 63a of the German Copyright Act, which was intended to support a distribution to publishers, new provisions (§ 27 II and § 27a VGG) were introduced by the German legislator to allow a distribution to publishers. Publisher participation in remuneration is therefore only possible on the basis of rights assigned to them by authors, which the publishers can then transfer to a collecting society. Since then, VG WORT distributes to publishers on the basis of individual assignment of authors.
