US Supreme Court to decide whether to review Authors Guild v. Google on April 1

Following the decision of the US Second Circuit Court of Appeals on 16 October 2015 in Authors Guild v. Google, which had confirmed the decision of Judge Chin according to which the scanning activities of Google within its Library Project are to be considered “fair use”, the Authors Guild filed a petition asking for Supreme Court review.

On 15 March, the Authors Guild filed with the Supreme Court a final brief, arguing that “at the heart of this conflict is a fundamental disagreement about how to apply the Copyright Act in the digital age, an issue [the Supreme Court] must resolve, as more and more content is digitized and becomes susceptible to mass infringement”.

The Court will decide whether or not to take the case on the 1st of April. Find here the Authors Guild full briefing.
